Please read this Privacy Policy, which is a part of the Terms and Conditions (collectively with the Payment Policy, the “Terms”) carefully before using the Foggie software, web or mobile applications (“Foggie”), or any associated product or services. Any defined term not defined in this Payment Policy has the meaning assigned to it elsewhere in the Terms.
The purpose of this Privacy Policy is to inform you about the information we will possibly collect about you whenever you visit our website, access your Foggie, make a payment, use the Services, or when you register or create an Account, how such information will be used by us or other persons or entities, with whom such information may be shared, your choices regarding the collection, use and distribution of such information, your ability to edit, update, correct or delete such information and the security procedures that we have implemented to protect your privacy.
This Privacy Policy only applies to data collected through Foggie and further only applies to the practices of Fog Works, Inc., our assignees, transferees, and to people that we employ or manage. Companies with whom we contract, promote, or allow access to have their own privacy statements and you must visit their websites if you need to have more information about their policies. This Privacy Policy does not cover any information that we may receive about you through sources other than the use of Foggie and the Services. Foggie, its website, and Services may link out to other websites or mobile applications, but this Privacy Policy does not and will not apply to any of those linked websites or applications

We collect and log traffic of Foggie and the Services and we may view, but not alter or access, any User Content you create without your express permission, for any reason, especially if we have reason to believe it violates the Terms.
To subscribe to Foggie, we need some basic information from you. When you create an Account, we require the following limited information in order to create the account, provide certain Services, and process payments:
- An email address
- A credit card (including name, card number, expiration date, CVV, country, and postal code)
- Preferred billing cycle (monthly or annually)
- Users who sign up for our Service using credit card will also be asked to provide:

- A phone number

In addition, access to user or subscriber personal information is restricted to those who need to know such information to perform their job functions.

If you have an account with us, we will verify the request by confirming the email address used to make the request is the same as the email address on file for the account. If you do not have an account with us, we will verify the request by sending an email to the email address used to make the request. The categories of California consumers’ personal information we may collect are listed above in the section titled “What do we collect?” We collect this data from our customers and website visitors. We confirm we have not sold any personal information to third parties for a business or commercial purpose in the preceding 12 months. We confirm we do not sell personal information of minors under 16 years of age without authorization. We may disclose the categories of Personal Information listed in the section “What do we collect?” to our vendors and service providers for a business purpose, as explained further in the section above titled “Third Parties.”
- Right to Request Deletion of Personal Information You have the right to request deletion of Personal Information collected or maintained by us. If you are a current or former customer submitting a request by web form or email, please provide sufficient information to identify your account, including your email address on file with us. You may be asked to verify your identity by responding to us with the email address on file for the account. If you are not a current or former customer, we may ask for proof of identity sufficient to show you are the same consumer about whom we have collected personal information that you are requesting to be deleted.
- Right to Opt-Out of the Sale of Personal Information You have the right to opt-out of the sale of your personal information by a business. Pursuant to California law, because we do not and will not sell your personal information, we do not offer such an opt-out at this time.
- Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights You have the right not to receive discriminatory treatment by the business for the exercise of the privacy rights conferred by the California Consumer Privacy Act.
